What are the laws regarding renting to a medical marijuana user?

I am currently renting a room to a medical marijuana user with an exemption card. This person insists on smoking marijuana on the balcony 10-15 times a day. There are other people in the unit that use the balcony as well. The smell drives them nuts and the children who live downstairs frequently visit upstairs to play with this person, and this person also "lights up" in front of the kids. I have searched Google and asked the Landlord & Tenant ociation about this and nobody can seem to give me a straight answer. Please, if you know of a *legal* way I can evict this person, post here and give me some resources/links I can check out as well.
